Anytime you interact with Treffen, such as when you visit our website, when you purchase products and services, or when you call our sales or support representatives you are agreeing to comply with and be bound by our terms and conditions. Please review the following terms carefully. If you do not agree to these terms, you should not use this website. The term Treffen, “us” or “we” or “our” refers to Treffen, a company based in Surat, Gujarat, India, and the owner of the Web site. The term “you” refers to the user or viewer of our Web Site.

Acceptance of Agreement

By using our site, Treffenjewelry.com (the “Site”), you agree to be bound by these Terms and Conditions (“Agreement”). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site and making a purchase from the company.

Pricing

All prices at checkout are final. We do not negotiate prices on our products. We make significant efforts to assure the pricing on our website is accurate at the time of purchase. However, we do reserve the right to cancel any and all sales when an inaccurate or erroneous price is displayed. We cannot honor inaccurate or erroneous pricing. If we cancel a sale after checkout, we will refund the fee listed on the check out receipt in the same manner as payment was made. For example, a credit card payment will be credited to the same card only. Our prices are also subject to change without notice. If a sale is canceled, the refund price represents the sole and exclusive damages available to you.

Only one coupon code may be used per order, if applicable. Multiple coupon codes cannot be combined or applied to a single purchase. Any attempt to use more than one coupon code will result in the automatic application of only the highest-value applicable coupon code. Additionally, once an order has been processed, no further price adjustments can be made.

Product Availability

All products displayed are typically in stock and available. There are times however when an inventory error occurs and an item is not available. Treffen reserves the right to cancel an order or substitute another item of like appearance and value for the original item purchased.

Our Stance on Conflict Diamonds

All diamonds sold on Treffen are purchased from legitimate sources not involved in funding conflict diamonds, and in compliance with United Nations resolutions. Treffen hereby guarantees that these diamonds are conflict free, based on personal knowledge and/or written guarantees provided by the supplier of the diamonds.

Photography

Items may appear larger or smaller than actual size due to photography methods or screen defaults. Images might also appear larger than actual size in order to show detail, or smaller than actual size in order to show an entire item. It is your responsibility to review the listed size and weight of each stone and not rely on photographs when determining your purchase.

Refund and Return Policy

Our Return Policy, as it may change from time to time, is a part of this Agreement and reflected fully on our website under our “Returns & Exchanges Policy”. All returns must be accompanied by the original documents sent to the customer. Any return of a diamond made without the original diamond grading report will be subject to a replacement fee. Please note, all insurance replacements are not covered through our Return policy.

Some jewelry and/or diamond item(s) may not qualify for a return per our return policy. In addition, due to the rarity and uniqueness of some of the loose diamonds we offer online, they may not qualify under our normal return/exchange policy and may be subject to a final sale.

While Treffen is happy to try and accommodate rush orders, a 10% restocking fee will be charged should the order be returned for any reason. The fee can be used as a credit towards any exchange or for a future order and never expires.

Comparison Purchasing

In an effort to keep our prices low for our valued clients, Treffen does not allow comparison purchasing. Comparison purchasing is the act of buying several items with the intent of keeping the one you like best and returning the remainder. This causes undue restocking and inventory overhead and can be very costly.

Payments

You represent and warrant that if you are purchasing something from us or from Merchants that (i) any credit information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes and shipping.

Lifetime Warranty

At Treffen, we stand behind the quality and craftsmanship of every piece we create. Our Lifetime Warranty covers manufacturing defects on all Treffen products. If you believe your item has a defect, you may send it to us for inspection. If Treffen determines that the issue originated during the manufacturing process, we will repair or replace the item at no cost to you.

If damage is determined to be the result of normal wear and tear, accidental damage, misuse, or any alteration, Treffen may perform the necessary repairs at the client’s expense, including return shipping. Any work, alteration, repair, resizing, or modification performed by a third-party jeweler, retailer, or repair shop immediately voids the Lifetime Warranty in its entirety.

All determinations regarding whether an issue constitutes a manufacturing defect, wear and tear, or third-party alteration are made solely at the discretion of Treffen.

Clients are responsible for all shipping costs incurred when sending items to Treffen for inspection. The Lifetime Warranty is non-transferable and becomes void if ownership of the item is transferred to another individual or entity.

Our Lifetime Warranty, Care & Maintenance, and Resizing Services are available to all clients worldwide.

Custom Jewelry

Custom Jewelry are designs for Jewelry, belonging to and submitted by customers (“Custom Design”). As such you hereby agree and certify that the Custom Design (i) are your designs and do not belong to anybody else, and (ii) are not subject to any protectable intellectual property rights (trademark, copyright, etc.) of others. Once a customer submits payment to initiate a custom design draft, the design charge is not refundable. Custom jewelry items will not be cast and manufactured until the customer approves the drawings in writing via certified mail or email. Once the customer approves the drawings, the custom item is not eligible for return or replacement. Due to the intricate and labor-intensive nature of many custom jewelry items, any delivery estimate provided by a Treffen representative, whether oral or written delivered by any medium, is merely an approximate date, and is not a guaranteed date for delivery. Actual delivery dates may vary, up to 10 business days from the delivery estimate date. Custom jewelry is covered by our lifetime warranty and care and maintenance programs. Treffen owns all designs, renderings, drawings and models submitted to or created by our employees and/or our designers. By submitting and casting your Custom Design, you hereby grant Treffen an irrevocable, perpetual, nonexclusive, royalty-free, fully paid-up, worldwide license to use, copy, modify, and display any portion of the Custom Design incorporated into any Custom jewelry developed and delivered by you. We reserve the right to market, publicize and share any and all designs and images of the Custom Design, which website display may differ from the pictured stock images on the site. You agree that if Treffen gets charged or accused of violating somebody else’s protected intellectual property as a result of Treffen’s production of the Custom Design, you hereby agree to indemnify and hold harmless Treffen, its officers, directors, shareholders, employees or agents (the “Indemnified Parties”) from any and all liabilities, losses, damages, claims, suits, judgments, costs and expenses (including reasonable attorneys’ fees and costs of any investigation or action related thereto) (“Losses”) suffered or incurred by the Indemnified Parties.

Setting a Diamond(s) or (Gem) Stone(s) Not Purchased from Treffen

At Treffen, we commit to providing a superior level of service and craftsmanship for every ring or jewelry item. However, there may be a situation where a loss or breakage of stone(s) or diamond(s) may occur. Loss of stone(s) or breakage of stone(s) once in the Treffen Workshop will not be covered for replacement by Treffen. It is the understanding of the client that there is a possibility of loss or damage of stone(s) sent to Treffen during the production process. Should there be a need to replace a diamond or stone, Treffen will convey the details of the loss or breakage to the client along with a replacement cost.

Ring Resizing

Any ring purchased from Treffen can be sent back at any time during its lifetime for a free resizing. The customer is responsible for any shipping charges to and from our facility incurred for resizing. To ensure that you order the correct ring size, please see our Ring Size Information page. Please note that diamond eternity bands, some custom designs and some materials cannot be resized.

Watch

The watch shown in product images is presented for design reference and demonstration purposes only. The base watch used in the final product is sourced from independent third-party suppliers.

Treffen Jewelry does not manufacture the watch itself. Our work is limited to the custom jewelry design, decorative setting, and craftsmanship applied to the watch.

Treffen Jewelry is not affiliated with, authorized by, sponsored by, or associated with any watch brand or manufacturer that the base watch design may resemble. All trademarks, brand names, and logos belong to their respective owners.

The primary value of this product lies in the artistic customization and jewelry craftsmanship performed by Treffen Jewelry.

Gift Cards & Certificates

You may purchase Treffen Gift Cards or Certificates. When you purchase an electronic Gift Card, we notify the person you have designated as the recipient of the Gift Card or Certificate by email. Unless otherwise required by applicable law, Treffen Gift Cards or Certificates are non-returnable and non-refundable.

Use of Information

We reserve the right, and you authorize us, to the use and assignment of all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy. All remarks, suggestions, ideas, graphics, or other information communicated by you to us (collectively, a “Submission”) will forever be our property. We will not be required to treat any Submission as confidential, and will not be liable for any ideas and will not incur any liability as a result of any similarities that may appear in our future products, services, or operations.

Privacy Policy

Our Privacy Policy, as it may change from time to time, is a part of this Agreement. You may review the privacy policy as currently stated on the Treffen website.

Registration

Certain sections of, or offerings from, the Site may require you to register. If registration is requested, you agree to provide us with accurate, complete registration information. Your registration must be done using your real name and accurate information. Each registration is for your personal use only and not on behalf of any other person or entity.

Errors, Corrections and Changes

We do not represent or warrant that the Site will be error-free, free of viruses or other harmful components, or that defects will be corrected. We do not represent or warrant that the information available on or through the Site will be correct, accurate, timely or otherwise reliable. We may make changes to the features, functionality or content of the Site at any time. We reserve the right to correct or remove any and all errors when they occur.

Unlawful Activity, Compliance with Law, and Fraud Protection

Treffen may collect and disclose any information, including personally identifiable information, we deem necessary, in our sole discretion, to comply with any applicable law and regulation, government request, or legal process. In addition, we may collect and share personally identifiable information and any other information available to us in order to investigate, prevent or take action regarding suspected fraud, illegal activities, and situations involving potential threats to the physical safety of personal or as otherwise required by law.

Property Abandonment

If the customer fails to pick up or accept delivery of purchased item(s) within 90 days of the initial notification item(s) are ready for pick up or delivery, Treffen will consider the property abandoned and has the right to resell, dispose of, or use any such products in any way it chooses.

Lost or Stolen Package Policy

In the rare event a package is lost or stolen while in transit from our offices to the shipping address, you must notify Treffen in writing within 3 business days of the order status being changed to “Complete.” The customer agrees to fully cooperate with any and all investigations required to recover the lost or stolen package, including (but not limited to) filing a police report with the appropriate department. Treffen cannot be held liable for any lost or stolen packages reported more than 3 business days after the order status is marked “Complete.”

Third Party Content

Third party content may appear on the Site or may be accessible via links from the Site. We are not responsible for and assume no liability for any mistakes, misstatements of law, defamation, omissions, falsehood, obscenity, pornography or profanity in the statements, opinions, representations or any other form of content on the Site.

Copyright

The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site is strictly prohibited.

Limited License; Permitted Uses

You are granted a non-exclusive, non-transferable, revocable license (a) to access and use the Site strictly in accordance with this Agreement; (b) to use the Site solely for internal, personal, non-commercial purposes; and (c) to print out discrete information from the Site solely for internal, personal, non-commercial purposes and provided that you maintain all copyright and other policies contained therein.

Indemnification

You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, attorneys, advertisers, product and service providers, and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of the Site.

Termination

Regardless of the terms of this agreement, Treffen reserves the right to terminate or block your use of our site or services at our sole discretion. This may include preventing your ability to make purchases on our site or refusing to fulfill an order of our products made by you.

Disclaimer & Limitation of Liability

THE INFORMATION, CONTENT, AND DOCUMENTS FROM OR THROUGH THE SITE ARE PROVIDED “AS-IS,” “AS AVAILABLE,” WITH “ALL FAULTS”, AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED. WE AND ANY AFFILIATED PARTY SHALL NOT BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING IN ANY WAY FROM (A) ANY ERRORS IN OR OMISSIONS FROM THE SITE OR ANY SERVICES OR PRODUCTS OBTAINABLE THEREFROM, (B) THE UNAVAILABILITY OR INTERRUPTION OF THE SITE OR ANY FEATURES THEREOF, (C) YOUR USE OF THE SITE, (D) THE CONTENT CONTAINED ON THE SITE, OR (E) ANY DELAY OR FAILURE IN PERFORMANCE BEYOND THE CONTROL OF US OR ANY AFFILIATED PARTY (F) DAMAGES AS A RESULT OF A CANCELLED ORDER OR REFUNDED ITEM.

Copyrights & Copyright Agents

We respect the intellectual property of others, and we ask you to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent the following information to info@treffenjewelry.com: a description of the copyrighted work, a description of where the material is located on the Site, your contact information, and a statement by you made under penalty of perjury that the use is not authorized.

Arbitration and Legal Controversy

Any legal controversy or legal claim arising out of or relating to this Agreement or our products or services, excluding legal action taken by us to collect or recover damages for, or obtain any injunction relating to, Site operations, intellectual property, and our services, shall be settled solely by binding arbitration in accordance with the applicable arbitration rules of India. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Surat, Gujarat, India, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

Miscellaneous

This Agreement shall be treated as though it were executed and performed in Surat, Gujarat, India, and shall be governed by and construed in accordance with the laws of India and the State of Gujarat (without regard to conflict of law principles). Any cause of action by you with respect to the Site (and/or any information, Documents, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be forever waived and barred.
